EXAMFLIX TERMS AND CONDITIONS

Welcome to Examflix. By accessing or using our platform, you agree to comply with and be bound by the following Terms and Conditions. Please read them carefully.

1.  DEFINITIONS

“Platform” means the Examflix website, mobile applications, and any related services provided by Examflix.

“Examflix”, “we”, “us”, or “our” refers to Examflix company, the company operating the Platform.

“User”, “Student”, or “you” refers to any individual accessing or using the Platform for learning purposes.

“Content” includes lessons, videos, quizzes, notes, and other educational materials made available on the Platform.

“User Content” means any content, comments, or materials submitted, posted, or displayed by a User on the Platform.

“Subscription” means a paid, time‑based access plan that grants access to certain Content.

“Content Partners” refers to third parties who provide Content to Examflix under license or other arrangement.

“Mock Exam” means a practice examination offered through the Platform, which may be automatically or manually graded.

“Webinar” means a live or pre‑recorded online seminar offered through the Platform.

2.  ACCEPTANCE OF TERMS

By creating an account or using the Platform, you:

• Confirm that you have read, understood, and agree to be bound by these Terms.
• Agree to comply with all applicable laws and regulations.
• Accept responsibility for all activity conducted through your account.

If you do not agree to these Terms, you must not use the Platform.

3. ELIGIBILITY

• You must be at least 13 years old to use the Platform.
• If you are under 18, you represent that you have obtained permission from your parent or legal guardian, and that they agree to be bound by these Terms on your behalf and accept responsibility for your use of the Platform.

4. USER ACCOUNTS

• You must provide accurate, current, and complete information when creating an account and keep that information updated.
• You are solely responsible for maintaining the confidentiality of your login credentials.
• You must not share your account credentials with any other person. If you suspect unauthorized access to your account, you must notify us immediately.
• Examflix reserves the right to suspend or terminate any account that violates these Terms or is used in a manner that harms the Platform or others.

5. USE OF THE PLATFORM

You agree to use Examflix only for lawful educational purposes.

You must NOT:

• Copy, reproduce, distribute, or resell any Content without our express written permission.
• Share paid Content or Subscription access with non‑paying individuals.
• Attempt to hack, disrupt, reverse‑engineer, or interfere with the Platform, its servers, or its security.
• Use any automated system (e.g., bots, scrapers) to access the Platform.
• Upload or transmit any harmful, offensive, fraudulent, or misleading material.
• Violate any applicable laws or the rights of third parties.

6. INTELLECTUAL PROPERTY

6.1.    Examflix Content

All Content provided by Examflix or its Content Partners is owned by Examflix or its licensors and is protected by copyright, trademark, and other intellectual property laws. Your use of the Platform grants you a personal, non‑exclusive, non‑transferable, revocable license to access and view the Content for your own personal, non‑commercial learning purposes. Any unauthorized reproduction, distribution, or public display is strictly prohibited.

6.2.    User Content

You retain ownership of any User Content you submit. By submitting User Content, you grant Examflix a non‑exclusive, worldwide, royalty‑free, perpetual license to use, reproduce, modify, adapt, publish, and display such User Content for the purpose of operating, improving, and promoting the Platform. You represent that you have all rights necessary to grant this license.

7. PAYMENTS AND SUBSCRIPTIONS

• Certain Content or features may require payment or a Subscription. Fees are clearly displayed before you complete a purchase.
• Users under 18 must obtain parental or legal guardian consent before making any payment or entering into any subscription agreement.
• Subscriptions automatically renew at the end of each billing cycle unless you cancel at least 48 hours before the renewal date. You can cancel or manage your Subscription through your account settings.
• Refund Policy: Fees are non‑refundable except as required by law or as expressly stated in a specific offer. If you believe an error has occurred, please contact us within 14 days of the charge. Refunds for one‑time purchases may be considered on a case‑by‑case basis.
• Examflix reserves the right to change pricing or Subscription plans at any time, with notice provided to users before such changes take effect.

8. PROMOTIONS AND DISCOUNTS

From time to time, Examflix may offer promotional campaigns, discounts, or free trials. Such offers are subject to specific terms communicated at the time of the offer. Examflix reserves the right to modify, suspend, or withdraw any promotion or discount at any time without prior notice, to the extent permitted by law.

9. ACCESS TO CONTENT

• Access to paid Content or Subscription Content is provided only for the duration of your active Subscription or the specific period stated at the time of purchase.
• Upon cancellation, expiration, or termination of your Subscription, your access to paid Content will cease.
• Examflix does not guarantee permanent availability of any specific Content. We may update, modify, or remove Content at our discretion.

10. COURSE‑SPECIFIC TERMS

Certain courses offered on the Platform may be subject to additional terms and conditions. These course‑specific terms will be presented to you in the course introduction or during the enrollment process. By enrolling in such a course, you agree to be bound by those additional terms. In the event of any conflict between these general Terms and the course‑specific terms, the course‑specific terms shall govern with respect to that course.

11. CONTENT ACCURACY DISCLAIMER

While Examflix strives to ensure the accuracy, currency, and relevance of its Content, we do not warrant or guarantee that all materials are error‑free, complete, or fully aligned with the syllabus or requirements of any specific examination board (including ZIMSEC, Cambridge, or others) at all times. Users are encouraged to verify critical information with official sources. Examflix shall not be liable for any adverse outcomes resulting from reliance on the Content.

12. DEVICE & INTERNET RESPONSIBILITY

You are responsible for obtaining and maintaining the necessary devices, internet connectivity, and software required to access the Platform. Examflix shall not be liable for any access issues, interruptions, or performance problems arising from your own hardware, software, internet service provider, or other user‑side limitations.

13. MOCK EXAMS

13.1. Participation 

Examflix may offer Mock Exams to help students prepare for their official examinations. Mock Exams are conducted entirely at the discretion of Examflix, and participation may be subject to additional fees or included in a Subscription.

13.2. Exam Administration

Mock Exams will be held regardless of whether a student has completed or covered the relevant topics on the Platform or at his/her school. It is the student’s responsibility to assess their own readiness before registering for or taking a Mock Exam.

13.3. Results and Grading

After a Mock Exam, individual results will be sent to the student via the email address associated with their account within seven days. While Examflix uses reasonable efforts to ensure accurate grading, you agree to indemnify and hold Examflix harmless against any claims, losses, or damages arising from alleged errors in marking, grading, or result calculation. Mock Exam results are provided for practice purposes only and do not guarantee any outcome in official examinations.

13.4. Publication of Top Performers

Examflix may publish a leaderboard of the top 10 performing students in each Mock Exam. Such publication may include the student’s name, score, and rank, and may be shared on the Platform, social media, or other marketing channels. By participating in a Mock Exam, you consent to such publication unless you notify us in writing prior to the exam.

14. WEBINARS

14.1. Webinar Programme

Examflix may offer live or recorded Webinars as part of its educational services. The schedule, topics, and speakers for upcoming Webinars will be published on the Platform. It is your responsibility to review the programme details before registering or making any payment for a Webinar.

14.2.    Scope of Webinar

Webinars are provided for informational and educational purposes only. You acknowledge that the content of a Webinar may not cover all topics within a subject or syllabus. Examflix shall not be liable for any expectation that a Webinar will cover specific material unless expressly stated in the published programme.

14.3. Registration and Payment

Some Webinars may require separate registration or payment. By registering, you confirm that you have reviewed the programme and understand the scope of the Webinar. Fees for Webinars are non‑refundable unless the Webinar is cancelled by Examflix.

15. COMMUNITY AND USER CONTENT

15.1. Community Features

The Platform may include community features such as discussion forums, comment sections, or other interactive areas where users can post User Content.

15.2. User Content Responsibility

You are solely responsible for any User Content you post. You agree not to post any content that is:

• Defamatory, abusive, obscene, or otherwise offensive;
• Infringing on any third‑party intellectual property or privacy rights;
• Fraudulent or deceptive;
• Intended to harass, bully, or harm others.

15.3. Moderation

Examflix reserves the right, but has no obligation, to monitor, review, edit, or remove any User Content at its sole discretion. We may suspend or terminate access to community features for users who violate these Terms.

15.4. Community Guidelines

In addition to these Terms, users must comply with any community guidelines posted on the Platform. Violation of such guidelines may result in restrictions or removal from community features.

16. ACADEMIC INTEGRITY

Users are expected to:

• Complete assignments, quizzes, and assessments honestly.
• Refrain from cheating, plagiarism, or any misuse of educational materials.
• Violations of academic integrity may result in suspension or termination of your account, without refund of any fees paid.

17. Limitation of Liability

To the maximum extent permitted by law:

• The Platform and all Content are provided “as is” and “as available” without warranties of any kind, whether express or implied. We do not warrant that the Platform will be uninterrupted, error‑free, or secure.
• We are not responsible for any examination results, academic outcomes, or other consequences arising from your use of the Platform.
• Limitation of Damages: In no event shall Examflix, its affiliates, officers, employees, or agents be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising out of or in connection with these Terms or your use of the Platform.
• Total Liability: Our total liability to you for any claims arising out of or relating to these Terms or the Platform shall not exceed the total amount you have paid to Examflix in the twelve (12) months preceding the event giving rise to the liability.

18. INDEMNITY

You agree to indemnify, defend, and hold harmless Examflix and its affiliates, officers, directors, employees, and agents from and against any and all claims, liabilities, damages, losses, costs, or expenses (including reasonable legal fees) arising out of or in connection with:

• Your use of the Platform;
• Any User Content you submit;
• Your violation of these Terms;
• Any claim related to Mock Exam results or grading, as set forth in Section 13.3.

19. PRIVACY

Your personal data will be collected, used, and protected in accordance with our Privacy Policy, which is incorporated into these Terms by reference. By using the Platform, you consent to such processing.

20.  TERMINATION

You may stop using the Platform and close your account at any time.

Examflix may suspend or terminate your account and access to the Platform if:

• You violate these Terms or any applicable law;
• Your use poses a security risk or may harm the Platform or other users;
• You engage in fraudulent, abusive, or illegal activity.

Upon termination, your right to access the Platform will cease immediately, and you will not be entitled to any refunds for unused Subscription periods.

21. CHANGES TO TERMS

We may revise these Terms from time to time. If we make material changes, we will provide notice through the Platform or by other reasonable means. Your continued use of the Platform after the effective date of the changes constitutes your acceptance of the updated Terms.

22. THIRD-PARTY LINKS

The Platform may contain links to third‑party websites, applications, or resources that are not owned or controlled by Examflix. We provide these links for convenience only and do not endorse, assume responsibility for, or make any representations regarding the content, accuracy, privacy practices, or availability of such third‑party sites. Your interactions with third‑party services are governed solely by the terms and policies of those third parties.

23. GOVERNING LAW AND DISPUTE RESOLUTION

23.1.    Governing Law

These Terms shall be governed by and construed in accordance with the laws of Zimbabwe, without regard to its conflict of laws principles.

23.2. Dispute Resolution

Any dispute, claim, or controversy arising out of or relating to these Terms or the Platform shall first be addressed through good‑faith negotiations. If the dispute cannot be resolved informally within 30 days, it shall be referred to binding arbitration in Harare, Zimbabwe, under the rules of the Commercial Arbitration Centre of Zimbabwe (or a similar recognized body). The arbitrator’s decision shall be final and binding, and judgment may be entered in any court having jurisdiction thereof. Each party shall bear its own costs unless the arbitrator determines otherwise.

24. GENERAL PROVISIONS

• Force Majeure: Examflix shall not be liable for any delay or failure to perform resulting from causes outside its reasonable control, including natural disasters, war, internet outages, or government actions.
• Severability: If any provision of these Terms is found to be unenforceable, the remaining provisions shall remain in full force and effect.
• Waiver: Our failure to enforce any right or provision shall not constitute a waiver of such right or provision.

26. ACKNOWLEDGMENT

By using Examflix, you acknowledge that you have read, understood, and agreed to be bound by these Terms and Conditions. You also agree that your use of the Platform constitutes an electronic signature and is legally binding.
